By sending a deposit, the client confirms that they have read, understood, and agreed to the following Terms and Conditions as outlined on www.85focal.com.

1. PHOTOGRAPHER’S WORK

1.1. Includes pre-session consultation, outfit/location guidance (styling referrals available for an added fee), and session planning.
1.2. Photographer captures only still photos. Video, behind-the-scenes are not included .
1.3. Digital Photography: Includes image selection, professional retouch of temporary skin blemishes (e.g. pimples/redness), with standard color correction and toning.
1.4. Film/Analog Photography: Film stocks and formats (120 film, 35mm, Polaroid, instant film) are selected based on lighting, subject, and aesthetic. Photographer selects and scans the best exposures.
1.5. No retouching is done on permanent features (e.g. wrinkles, scars, body shape, makeup, hair or backgrounds) , as part of the standard editing process. However, advanced retouching services are available by request at an additional rate of $20 per image, depending on complexity.
1.6. Session durations vary by package, ranging from 1–5 hours.

2. PRICING & SERVICES

2.1. All rates are listed at www.85focal.com/services .Engagement, proposal, and wedding sessions are custom-priced and will be estimated based on the client’s unique needs, coverage time, locations, and creative requirements. A formal quote will be provided after an initial consultation.
2.2. Pricing includes pre-shoot consultation, photography time, Assistants, post-processing, professional-grade gear, data storage, software, and transport.
2.3. Clients receive a private online gallery with high-resolution downloads, active for 8 days or 2 weeks. Clients are encouraged to download and save backups.
2.4. Photos are archived for 2 months. Free restoration during this time if images are lost.
2.5. Additional hour of shooting: $75/hr  (may vary depend of packages or availability ).
2.6. RAW digital files may be purchased within 1 month for $200.
2.7. Additional retouching: $20 per photo (requests must be made within 5 days of delivery).
2.8. Studio : Studio session rates include .
2.9. Film & Instant Photography Costs:

• 1 roll of 120 film + 1 Polaroid pack (8 shots): $25–$30

• 2 rolls + 2 Polaroid packs (16 shots): $50–$60
  These costs are reflected in Analog Packages and must be prepaid as part of the deposit.

2.10. The photographer is not responsible for client’s personal items.

3. PAYMENT & DEPOSITS

3.1. A non-refundable deposit is required to reserve your session:

• Portraiture (Digital): $50

• Studio Sessions: $150 (includes partial studio rental coverage)

• Analog Sessions (Film, Instant Film, Polaroids): $100-$175 depending on package.

• Weddings & Events: 20% of the total estimated quote

3.2. Payments accepted: Zelle, Venmo, PayPal, Apple Pay, or cash.
3.3. Both deposits and final payments are made via invoice, sent through Squarespace. A standard transaction fee (approx. 3.2% + $0.30) applies to all card payments processed through the invoice.
3.4. Sessions are not booked until a deposit is received by the invoice or payment above.
3.5. If the photographer cancels, a full refund will be issued.
3.6. If the client cancels, deposit is non-refundable.
3.7. Remaining balance is due the same day as the session. No images are delivered until full payment is received.
3.8. Dissatisfaction with creative style is not valid for a refund.
3.9. Entry fees for locations (e.g. museums, rooftops or permit photo locations ) are paid by the client.

4. CANCELLATION

4.1. Client cancellations forfeit the deposit. Photographer cancellations receive a full refund.

5. RESCHEDULING & LATE POLICY

5.1. Rescheduling is allowed 2x within 8 months of the original date.
5.2. NYC delays happen — a 10-minute grace period applies. Please plan accordingly.

5.3. Time lost due to client lateness is deducted from the session without refund.
5.4. No-shows ,unannounced absences or excessive delays (over session time) incur or owe 50% of session fee.
5.5. If photographer is late by 10+ minutes, extra time will be added or partial refund provided.

6. STYLE & ARTISTIC RIGHTS

6.1. Clients agree to photographer’s editing style and aesthetic as seen in portfolio.
6.1. Photographer has creative control over all edits and delivery.
6.2. Disagreements over style are not valid for refunds.
6.3. Clients may request to keep images off the public site/portfolio for a 10% fee (must make a request before the session).
6.4. Clients receive final, edited images with non-commercial use rights. — RAWs are not included unless purchased.
6.5. 85Focal (Photographer) retains copyright for all images and may use them for self-promotion, portfolio, and online, unless agreed otherwise in writing.

7. EXCLUSIVITY

7.1. 85Focal will be the sole hired photographer unless specified.
7.2. Both parties agree to communicate openly, professionally and respectfully for a positive creative process.
