1. PHOTOGRAPHER’S WORK

1.1. Includes pre-session consultation, location and outfit guidance (styling referrals available for an added fee), and shoot planning.

1.2. Photographer will only take photos during the session. Video, behind-the-scenes are not included .

1.3. Images are selected and edited by the photographer. Edits include adjustments to brightness, contrast, color tones, and retouching of temporary skin issues (e.g. pimples, redness).

1.4. Permanent features such as body shape, wrinkles, scars, incorrect makeup or hair, and background objects will not be retouched.  

1.5. Sessions last a minimum of 1 hour and up to a maximum of 5 hours depending on the package (not includes events or wedding).

2. PRICES AND SERVICES

2.1. All pricing and package details are available at www.85focal.com/services

2.2. Rates include consultation, photography time, Assistants, editing, transport, professional-grade equipment, software, storage, and maintenance.

2.3. Clients receive a type of online gallery of high-resolution images, available for 2 weeks. Clients are encouraged to download and save backups.

2.4. Files will be archived for 4 months in case of loss. Restoration during that time is free.

2.5. Additional hours: depending on availability, $50/Half hour  (personal shoots only and may vary depend of packages).

2.6. RAW files may be purchased for $150.

2.7. Any additional editing requests must be made within 5 days of gallery delivery.

2.8. The photographer is not responsible for lost or damaged personal items. 

2.9. Referrals for makeup, hair, and styling can be provided. These are third-party services and not included in the photo session fee. 

2.10. Additional edits: $20 per photo.

3. PAYMENT

3.1. Deposit amounts:

    * $50 for personal and couple

    * $100 for studio sessions

    * 20% of total for weddings

3.2. Payments accepted via Zelle, Venmo, cash, PayPal, or Apple Pay (card fees +5%). 

3.3. Booking is confirmed only after deposit is received by the invoice or payment above. 

    * Deposits are non-refundable unless the photographer cancels. 

    * If photos are lost due to the photographer’s fault, a full refund will be issued.

    * Dissatisfaction with creative style is not valid for a refund. 

3.4. Remaining balance is due the day of the session. No photos will be delivered until full payment is received. 

3.5. Client covers entry or permit fees for paid photo locations.

4. CANCELLATION

4.1. Client cancellations result in forfeiture of the deposit. Photographer cancellations result in a full refund.

5. RESCHEDULING / LATE ARRIVALS

5.1. Clients may reschedule up to 2 times within 8 months. After that, the booking is void with no refund.


5.2. NYC transit can delay your arrival. Please plan accordingly.


5.3. There’s a 10-minute grace period. Time after that is deducted from the session.


5.4. If late arrival equals session length, client must pay 50% of the total.


5.5. No-shows or unannounced absences also owe 50% of the total.


5.6. If the photographer is more than 10 minutes late, that time will be added to the session or refunded.
5.7. COVID-related rescheduling is allowed on both sides. Photographer is vaccinated and can show proof if requested.

6. STYLE

6.1. Client agrees to the photographer’s style and aesthetic based on portfolio.

6.2. The photographer has creative control over all edits and delivery.

6.3. Style disputes are not valid reasons for refunds or contract cancellations.

7. ARTISTIC RIGHTS

7.1. Clients receive non-commercial use rights.

7.2. 85 Focal retains all copyright to the images and may use them in portfolio, online, and promotional use.

7.3. Clients who wish to opt out of public portfolio use must make a request before the session. This opt-out is available for 10% of the session fee.

7.4. Clients receive final edited images only, not all raw materials.

8. EXCLUSIVITY

8.1. 85Focal will be the sole photographer for your session.

8.2. Both parties agree to collaborate professionally and respectfully for the best creative results.
